Facts:
Uber Drivers are workers not self-employed, Supreme Cort Rules
Due to the Supreme Court decision in February 2021, Uber drivers are classed as workers, not as self employed. This means Uber drivers have rights as workers. They are entitled to the minimum wage while logged in to the app. We estimate that the average Uber driver is entitled to around £15,000 in compensation.
Uber treated the drivers as independent, self- employed contractors, not employees or ‘workers’. It argued that it was acting as their agent when dealing with potential passengers, not as their employer. This meant that they were not allowed employment law rights such as national minimum wage, paid working hours and auto-enrolment pension contributions.
However the Supreme Court has ruled that Uber drivers are classed as workers and are therefore entitled to minimum wage and paid holidays. This means you are able to claim back your earnings if you we’re paid under minimum wage and also if you had any unpaid holiday.
